Telehealth Informed Consent
Please read this document carefully before receiving telehealth services through the RightMD platform.
RightMD INC ("RightMD," "we," "our," or "us") provides websites, applications, and services (collectively, the "RightMD Services") that allow patients to connect with independent, licensed healthcare professionals for medical consultations through telehealth technologies.
The RightMD Services facilitate Telemedicine Services, which may include virtual consultations, medical assessments, and prescription decisions made by licensed healthcare providers when clinically appropriate.
RightMD does not practice medicine and does not replace your primary healthcare provider. Medical care delivered through the platform is provided solely by independent licensed healthcare professionals.
Definitions
Telemedicine Service Providers
Telemedicine services made available through the RightMD platform are provided by independent medical practices and licensed providers. These providers may include physicians, nurse practitioners, physician assistants, or other licensed clinicians.
These Providers are solely responsible for:
- →Conducting medical evaluations
- →Determining appropriate diagnoses
- →Prescribing medications when clinically appropriate
- →Maintaining professional medical judgment
- →Complying with applicable federal and state laws and professional standards
RightMD does not control medical decision-making, and Providers exercise their independent professional judgment when delivering care. Providers using the RightMD platform are independent healthcare professionals and are not employees, agents, or representatives of RightMD.
Nature of Telehealth Services
Telehealth services involve the delivery of healthcare services through electronic communications when the patient and healthcare provider are not physically located in the same place.
Telehealth services may include:
- →Secure electronic transmission of medical records, images, and personal health information
- →Asynchronous communication such as secure messaging or online questionnaires
- →Real-time communication via audio or video consultation
- →Prescription review and medication management
- →Remote monitoring technologies when available
Potential Benefits of Telehealth
Increased convenience and access to healthcare services from anywhere.

Access to licensed providers regardless of geographic location.

Faster communication with healthcare professionals.
Potential Risks and Limitations
While telehealth services offer many benefits, there are also inherent limitations and risks.
A provider may not have sufficient clinical information to make a fully informed medical decision, which could require in-person evaluation.
Certain physical examinations, diagnostic procedures, or laboratory tests cannot be performed remotely.
Telehealth sessions may be affected by software malfunction, internet connectivity issues, or device failure.
Although reasonable security measures are implemented, electronic communications carry a risk of unauthorized access or data breach.
Certain services or prescriptions may not be available in all states due to applicable telehealth laws.
State-Specific Telehealth Disclosures
Telemedicine services are subject to varying state regulations. By using RightMD Services, you acknowledge and understand the following:
Telehealth services require patient consent prior to the consultation. Patients retain the right to request in-person medical care when available.
The Open Payments Database is a federal database used to search payments made by drug and device manufacturers to physicians and teaching hospitals.

Certain medications may not be prescribed through telehealth without an in-person evaluation.
Complaints regarding physicians licensed in Texas may be directed to the Texas Medical Board.
Providers delivering telehealth services must be appropriately licensed to practice in Florida.
Certain controlled substances may not be prescribed through telehealth under Florida law.
Additional telehealth regulations may apply depending on your state of residence. Patients are encouraged to review telehealth regulations applicable to their state or contact their state medical board for additional information.

By accepting this Telehealth Consent, you acknowledge and agree to the following:
Limitation of Liability and Disclaimers
RightMD provides a technology platform that facilitates communication between patients and independent healthcare providers. RightMD does not provide medical services and does not practice medicine.
Providers delivering medical care through the platform are independent healthcare professionals and are solely responsible for medical decisions, diagnoses, and treatment plans.
The availability of prescription medications through telehealth is subject to applicable federal and state laws and professional medical judgment. A prescription may or may not be issued following a consultation.
RightMD makes no guarantee that telehealth services will be uninterrupted, error-free, or continuously available.
To the fullest extent permitted by law, RightMD and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of telehealth services or the medical decisions of independent Providers.
RightMD Services are not intended for emergency medical situations. If you believe you are experiencing a medical emergency, you must immediately call 911 or go to the nearest emergency room.
Patient Informed Consent
By selecting "I Agree" or otherwise accessing the RightMD Services, you confirm that you have read and understood this Telehealth Informed Consent, you voluntarily consent to receive telemedicine services, and you understand the risks, limitations, and benefits of telehealth.
